PROFESSIONAL FEES AND EXPENSES

For Ship Arrest or Release anywhere in India

The following outlines the billing structure for services related to ship arrest or release in India. Please note that disbursements may vary based on the jurisdiction and High Court involved in the admiralty suit or ship arrest.

Breakdown and Methodology for Ship Arrest Work in India:

A. Professional Fees: A flat fee of USD 1350.

B. Institution/Court Fees: As per the applicable High Court's regulations.

C. Counsel/Associate Fees: Variable, depending on the level of counsel and associate expenses.

D. Traveling and Other Expenses: Billed on an actual cost basis, if applicable.

E. Launch Hire: Charges for executing the warrant of arrest will apply if the vessel is at anchorage.

F. Court Departmental and Other Expenses: Billed on an actual cost basis.

G. Photocopying and Miscellaneous Expenses: Billed on an actual cost basis.

Note: Item A pertains to our Professional Fees, while items B through G encompass Disbursements and Third-Party Expenses.

The above computation covers the period up to the filing of the admiralty suit, application for ship arrest, court appearances, and completion of service for the order or warrant of arrest.

Professional Fees Beyond Initial Arrest:

Our professional fees for services rendered subsequent to the issuance of the order of arrest or the completion of its service will be computed on a stage-wise basis. The standard calculation methodology is USD 180 per hour, plus actual disbursements incurred.

Fee Computation and Payment:

We will provide a detailed computation of fees and expenses and request an accountable advance payment. Work will commence upon receipt of this advance.

Power of Attorney:

To initiate the filing of the suit, a Power of Attorney is required. A format will be provided upon confirmation of our firm's appointment.

Team Involvement:

During this period, at least one solicitor will work on the case. If necessary, additional lawyers, paralegals, and associates will be involved to ensure the delivery of high-quality service at no additional cost. Disbursements will be contingent upon the jurisdiction and High Court where the admiralty suit is filed.

Claim Amount:

For the suit claim, approximately USD 18,000 is included in the claim amount and is sought from the opponent towards legal costs.

Billing Rates:

Our billing rates are calculated in USD, GBP, EUR, or INR, depending on the client's requirements.

Client Coordination:

Each client will be assigned a dedicated lead partner who will oversee, coordinate, and ensure effective fulfillment of client needs.

Ship Release:

For the release of a ship from an order of arrest, our professional charges are USD 207 per hour, plus actual disbursements. We also offer stage-wise lump sum fees in addition to disbursements on an actual cost basis.

Shipping Arbitration:

For shipping arbitration work within India, whether ad-hoc or institutional, our charges are USD 207 per hour, plus actual disbursements. Stage-wise lump sum fees are also available, along with disbursements on an actual cost basis.
